2 .- OBJECT
This Legal Notice regulates access, navigation and use of the website located at the URL https://tokenizedgreen.es/ (hereinafter, the” Web site ”) and by means of which we inform users about their rights and obligations in relation to the content shown in them, the logos and brands used, as well as the responsibilities that may arise from their use.
The purpose of the Website is, mainly, to act as an information portal and access portal for the user to the Tokenized Green website.
Access, browsing or use of the Website implies the express and unreserved acceptance of all the terms of this Legal Notice, having the same validity and effectiveness as any contract concluded in writing and signed. Notwithstanding the foregoing, Tokenized Green reserves the right to modify the presentation, configuration and content of the Website, as well as this Legal Notice, so it is recommended that users review it constantly.
3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
Tokenized Green is the owner or, where appropriate, has the corresponding licenses for intellectual, industrial, image or any other similar property rights on the Website, as well as all the content offered therein, including, but not limited to, photographs, illustrations, logos, brands, graphics, designs, interfaces, or any other information or content included therein.
Users only have a non-exclusive right of use, within a strictly personal environment and for the sole purpose of being able to navigate the Website in accordance with this Legal Notice.
4 .- RULES FOR USING THE WEBSITE AND THE APPLICATION
Access or use of the Website for illegal or unauthorized purposes, with or without economic purpose, is not allowed and, therefore, its consequences will be the sole responsibility of users.
Specifically, and without limiting this list, it is prohibited to:
(i) use the Website in any way that could cause damage, interruptions, inefficiencies or defects in the operation of these or in third-party devices;
(ii) use the Website for the transmission, installation or publication of any virus, trojan, worm, malicious code or other programs or files harmful or with unlawful intent;
(iii) use the Website to transmit material for advertising or promotional purposes, including spam, chain emails, or the like, without the prior express written authorization of Tokenized Green;
(iv) use the Website in a way that constitutes a violation of any rights of Tokenized Green or third parties;
(v) use the Website to transmit or publish any material that is defamatory, offensive, racist, vulgar, denigrating, pornographic, or of an obscene or threatening nature or that could annoy, harm or merely affect any person at the discretion of Tokenized Green;
(vi) use the Website to collect personal data from other users;
(vii) use the Website illegally, contrary to good faith, morals and/or public order;
(viii) unauthorized access to any section of the Website, to other systems or networks connected to them, to any Tokenized Green server or to the services offered through the Website by means of hacking or falsification, password extraction or any other illegitimate means or established in this Legal Notice;
(ix) carry out any action that causes disproportionate or unnecessary saturation in the infrastructure of the Website or in the systems or networks used or owned by Tokenized Green, as well as in the systems and networks connected to the Website.
Failure to comply with any of the above obligations by users of the Website may lead to the adoption by Tokenized Green of appropriate measures based on law and in the exercise of its legitimate interests.
5. RESPONSIBILITIES AND GUARANTEES
Tokenized Green cannot guarantee the reliability, usefulness or veracity of absolutely all the information contained on the Website, nor the usefulness or veracity of the content made available to users through them. Consequently, Tokenized Green does not guarantee or be responsible for:
(i) the continuity of the contents of the Website;
(ii) the absence of errors in such content;
(iii) the absence of viruses, trojans, worms and/or other malicious or technologically harmful components on the Website or on the server that supplies them ;( iv) the invulnerability of the Website and/or the impossibility of violating the security measures adopted therein;
(v) the lack of usefulness or performance of the contents of the Website;
(vi) failures of the Website caused by any type of attack on its servers or those of third-party Tokenized Green service providers, as well as technical or security failures in the system of any of these providers that prevent the proper functioning of the Website;
(vii) any technical failure, of any kind, that hinders, delays or impedes the proper functioning of the Website; (viii) any damage or harm caused, to himself or to a third party, by any person who violates the conditions, rules and instructions that Tokenized Green establishes on the Website or through the violation of security systems. Tokenized Green declares that it has taken all necessary measures, within its possibilities and the state of the art, to guarantee the operation of the Website and to reduce to a minimum the system errors, both from a technical point of view and of the content published on the Website. Tokenized Green will not be responsible for the veracity, integrity or updating of the information published on the Website from sources other than the same, nor for those contained on other platforms to which it links from the Website.
Tokenized Green reserves the right to suspend, modify, restrict or interrupt, either temporarily or permanently, access, browsing, use, hosting and/or downloading the content and/or use of services on the Website, with or without prior notification, to users who contravene any of the provisions detailed in this Legal Notice, without the possibility of demanding compensation for this cause.
6.- FORCE MAJEURE
Notwithstanding the foregoing, Tokenized Green will not be responsible for delays or failures that occur in the access, operation and operation of the Website, its Contents and/or Services, nor for interruptions, suspensions or malfunctioning of the same, when they are caused by breakdowns caused by any situation of force majeure or fortuitous cause. We will not be responsible for any breach or delay in carrying out any action, when it is due to events that are beyond our control reasonable (“Cause of Force Majeure”).
Causes of Force Majeure will include any act, event, lack of exercise, omission or accident that is beyond our reasonable control and, among others, the following:
(i) Strikes, lockouts or other protest measures.
(ii) Civil commotion, revolt, invasion, terrorist threat or attack, war (declared or not), or threat or preparations for war.
(iii) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
(iv) Impossibility of using trains, ships, airplanes, motor transports or other means of transport, public or private.
(v) Inability to use public or private telecommunications systems.
(vi) Acts, decrees, legislation, regulations or restrictions of any government or public authority. It will be understood that the above-mentioned actions will be suspended for the period in which the Cause of Force Majeure continues, and we will have an extension of the deadline to comply with them for a period of time equal to the duration of the Cause of Force Majeure. We will use all reasonable means to end the Cause of Force Majeure or to find a solution that will allow us to fulfill our obligations despite the Cause of Force Majeure.

Tokenized Green will respond to complaints or inquiries as soon as possible and, in any case, within a maximum period of one (1) month.
8.- CONFIDENTIALITY AND DATA PROTECTION
In accordance with the provisions of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of these data and repealing Directive 95/46/EC (hereinafter,” RGPD ”) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights (hereinafter,” LOPDGDD ”) all personal data provided during the use of the Website will be treated in accordance with the provisions of Privacy Policy that users must read and, where appropriate, accept and/or consent.
9.- SAFEGUARD CLAUSE
All the clauses or extremes of this Legal Notice must be interpreted independently, and the rest of the clauses are not affected if one of them has been declared null and void by a court ruling or a final arbitral decision. The affected clause or clauses will be replaced by another or others that preserve the effects sought by this Legal Notice.
10.- APPLICABLE LEGISLATION AND JURISDICTION
Access to and use of the Website will be governed and interpreted in accordance with Spanish legislation. In the event that any conflict or discrepancy arises in the interpretation and/or application of the Legal Notice or the Terms and Conditions of Purchase, the competent Courts will be those that provide for the applicable legal regulations.
